Sharing your login credentials with others is strictly prohibited and may result in account termination.

3. Health and Safety Disclaimer

Important: Please read this section carefully before beginning any face yoga program.

All You Can Face provides educational content about facial exercises, face yoga, and wellness techniques. Our Services are intended for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment, and should not be used as a substitute for professional medical care.

Consult a Healthcare Provider

Before beginning any face yoga program, we strongly recommend consulting with a qualified healthcare provider, particularly if you have or have had any of the following conditions: recent facial surgery, dental procedures, or oral surgery; temporomandibular joint (TMJ) disorder or jaw problems; skin conditions such as rosacea, eczema, psoriasis, or active acne; recent Botox, dermal fillers, or other cosmetic procedures; neck or spine injuries or conditions; conditions affecting facial nerves or muscles; high blood pressure or cardiovascular conditions; or any other medical condition that may be affected by facial exercises.

Discontinue If Necessary

Discontinue use of the Services immediately and consult a healthcare provider if you experience pain, dizziness, discomfort, numbness, tingling, or any adverse reaction during or after performing exercises.

No Guaranteed Results

Individual results vary and are not guaranteed. Face yoga is intended to complement, not replace, professional medical care. We make no claims that the Services will treat, cure, or prevent any medical condition.

4. User Content

Your Content

You retain ownership of any data, information, images, or material ("User Content") that you submit, upload, or create through the Services, including comments, photos, and community contributions.

License to All You Can Face

By submitting User Content, you grant All You Can Face a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, adapt, publish, and distribute your User Content for the purposes of providing, promoting, and improving the Services. This includes the right to use your User Content (including testimonials, before-and-after photos, and success stories) in marketing and promotional materials. We may use such content anonymously or with your name, and will make reasonable efforts to request additional consent before featuring you prominently in marketing campaigns, though such consent is not legally required under this Agreement.

Your Representations

By submitting User Content, you represent and warrant that you own or have the necessary rights to the content, that it does not violate any third-party rights, and that it complies with all applicable laws and these Terms.

Content Removal

We reserve the right to review, monitor, and remove any User Content that violates these Terms, is harmful, offensive, or otherwise objectionable at our sole discretion. You may request deletion of your User Content by contacting us at [email protected], though some copies may remain in backups for up to 30 days.

5. Intellectual Property

Our Content

All content within the Services, including but not limited to videos, images, text, graphics, logos, exercises, techniques, methodologies, course materials, and trademarks, is owned by All You Can Face or its licensors and is protected by copyright, trademark, and other intellectual property laws. This includes our proprietary techniques and methodology names.

Restrictions

You may not, without our express written permission: copy, reproduce, distribute, or republish any content from the Services; share, transfer, or disclose your login credentials to any third party; record, screenshot, download, or capture videos or other content for any purpose other than personal reference; use any content for commercial purposes, including teaching, reselling, or creating derivative works; modify, adapt, translate, reverse engineer, or create derivative works based on our content or methodology; remove, alter, or obscure any copyright, trademark, or proprietary notices; or use automated tools to access, scrape, or download content from the Services.

Limited Personal Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only, subject to these Terms.

6. Prohibited Uses

You agree not to use the Services to: violate any applicable laws or regulations; infringe upon the intellectual property rights of others; share your account or login credentials with others; engage in any activity that interferes with or disrupts the Services; upload or transmit viruses, malware, or other harmful code; harass, abuse, threaten, or intimidate other users; impersonate any person or entity; use the Services for any unauthorized commercial purpose; attempt to gain unauthorized access to any part of the Services; or collect or harvest personal information about other users.

7. Community Guidelines

Our Services include community features where users can interact with each other. By participating in our community, you agree to the following guidelines.

Expected Conduct

Be respectful and supportive of other community members. Share your experiences constructively. Provide encouragement and positive feedback. Respect differing opinions and experiences. Keep discussions relevant to face yoga, wellness, and the community purpose.

Prohibited Conduct

The following are not permitted: harassment, bullying, or personal attacks; hate speech, discrimination, or offensive content; spam, self-promotion, or unsolicited advertising; sharing of others' personal information without consent; medical advice or claims beyond personal experience; content that violates intellectual property rights; and any illegal or harmful content.

Enforcement

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice or refund.

8. Third-Party Services

The Services may integrate with or rely on third-party services, including but not limited to Kajabi (platform hosting), Stripe (payment processing), and PayPal (payment processing). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

9. Billing, Payments, and Refunds

Payment Processing

All payments are processed securely through our third-party payment processors (Stripe, PayPal, or Kajabi Payments). By making a purchase, you agree to the terms of the applicable payment processor. All fees must be paid according to the pricing and terms in effect at the time of purchase.

Foundation Program (Lifetime Access)

The Foundation Program is available for a one-time payment that grants lifetime access to the program content.

Refund Policy:

You may request a full refund within 21 days of purchase if you have used the program as instructed. To qualify for a refund, you must have logged into the platform and completed the video exercises for 21 consecutive days, as verified through our platform tracking. If you have not met these requirements, you are not eligible for a refund. To request a refund, contact us at [email protected] with your account details.

All-You-Can-Face Studio Membership

Studio Memberships are available on monthly or annual subscription plans.

Auto-Renewal:

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription rate.

Cancellation:

Monthly subscriptions may be cancelled at any time and will not renew for the following month. Annual subscriptions may be cancelled at any time and will not renew for the following year. No pro-rata refunds are provided for annual subscriptions cancelled before the end of the subscription period.

Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect existing paid subscriptions until renewal.

10. EU Consumer Rights and Right of Withdrawal

If you are a consumer in the European Union, you have certain rights under EU consumer protection laws.

Digital Content Waiver

For digital content and services with immediate access: By purchasing and requesting immediate access to digital content, you expressly consent to begin receiving the Services immediately upon purchase. You acknowledge that by doing so, you waive your 14-day right of withdrawal once access to the digital content is granted. This waiver applies only after you have expressly consented and acknowledged the loss of your withdrawal right.

Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable EU law, including the right to receive Services that conform to their description and are fit for purpose.

11. Termination

Termination by You

You may terminate your account at any time by contacting us at [email protected]. Termination does not entitle you to a refund of any fees paid.

Termination by Us

We reserve the right to suspend or terminate your account and access to the Services, without prior notice or refund, if you: violate these Terms or any applicable laws; share your login credentials with others; engage in abusive, harassing, or inappropriate behavior; initiate a chargeback or payment dispute in bad faith; engage in fraudulent activity; or otherwise misuse the Services.

Effect of Termination

Upon termination, your right to access the Services ceases immediately. For users with lifetime access who are terminated for violations of these Terms, access is revoked permanently without refund. Sections of these Terms that by their nature should survive termination will remain in effect.

14. Limitation of Liability

To the maximum extent permitted by applicable law, All You Can Face and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services.

Our total liability for any direct damages shall not exceed the amount you paid for the Services in the one month preceding the claim, or one euro (EUR 1) if no payment was made.

This limitation does not exclude or limit liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded by applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless All You Can Face and its directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your use of the Services; your User Content; your violation of these Terms; your violation of any third-party rights; or any injury or harm resulting from your use of the exercises or techniques provided through the Services.

16. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. Mandatory consumer protection laws of your country of residence may also apply.

Jurisdiction

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany. If you are a consumer in the EU, you may also bring proceedings in the courts of your country of residence.

Alternative Dispute Resolution

17. Changes to These Terms

For significant changes, we will provide notice via email or through the Services. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

Entire Agreement:

These Terms, together with any additional terms for specific Services, constitute the entire agreement between you and All You Can Face regarding the Services.

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver:

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment:

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
